These Terms of Use govern your access to and use of the services, platform, and content provided by Jikexao ("we," "us," or "our") through jikexao.pro and any associated subdomains or applications (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Acceptance of Terms

By creating an account, accessing any course, or otherwise interacting with the Platform, you confirm that you have read, understood, and agree to these Terms of Use, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Jikexao.

We reserve the right to update or modify these Terms at any time. Changes become effective upon posting to the Platform. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years of age to use the Platform. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal data from children under 13. If we become aware that a user is under 13, we will promptly close their account.

3. Account Registration

3.1 Account Creation

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are solely responsible for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account. We are not liable for any loss or damage resulting from your failure to maintain account security.

3.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions, obtain promotional benefits, or for any other purpose is prohibited.

4. Use of the Platform

4.1 Permitted Use

You may use the Platform solely for lawful, personal, non-commercial educational purposes, unless you have entered into a separate written agreement with us permitting commercial use. You agree to use the Platform in a manner consistent with all applicable laws and regulations.

4.2 Prohibited Conduct

You agree not to:

Copy, reproduce, distribute, or publicly display any course content without prior written permission
Share your account credentials with any third party
Use automated tools, bots, scrapers, or scripts to access or collect data from the Platform
Attempt to reverse engineer, decompile, or disassemble any part of the Platform
Upload, transmit, or distribute malicious code, viruses, or harmful software
Engage in any conduct that disrupts, damages, or impairs the Platform or its infrastructure
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Use the Platform to send unsolicited communications, spam, or promotional material
Attempt to gain unauthorized access to any part of the Platform or its related systems
Violate the intellectual property rights of Jikexao or any third party

5. Course Enrollment and Access

5.1 Enrollment

Upon enrollment in a course, you are granted a limited, non-exclusive, non-transferable license to access and view the course content for your personal educational use. This license does not include any right to sublicense, sell, or otherwise transfer access to any third party.

5.2 Access Duration

Access duration varies by course type and pricing plan. Specific access terms are disclosed at the point of purchase. We reserve the right to modify, update, or discontinue course content at any time, though we will make reasonable efforts to notify enrolled users of significant changes.

5.3 Certificates

Where applicable, certificates of completion are issued upon satisfying the stated requirements for a course. Certificates are for personal reference only and do not constitute an academic credential, professional qualification, or guarantee of employment.

6. Payments and Refunds

6.1 Pricing

Prices for courses and subscriptions are displayed on the Platform and may be subject to applicable taxes. We reserve the right to change prices at any time, with changes taking effect upon your next purchase or subscription renewal.

6.2 Payment Processing

All payments are processed through third-party payment providers. By providing payment information, you authorize the applicable payment processor to charge the stated amount. We do not store full payment card details on our systems.

6.3 Refund Policy

Refund eligibility is determined by the specific refund policy applicable to each course or subscription plan, as disclosed at the point of purchase. Where a refund period is offered, requests must be submitted to [email protected] within the stated timeframe. Refunds are not available for partially completed courses unless otherwise specified.

7. Intellectual Property

7.1 Our Content

All content on the Platform, including but not limited to text, video, audio, graphics, course materials, software, and the Platform's design and structure, is owned by or licensed to Jikexao and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or exploit any content without our express written consent.

7.2 User-Generated Content

If you submit, post, or upload any content to the Platform (such as forum posts, comments, or assignments), you grant Jikexao a worldwide, royalty-free, non-exclusive license to use, store, display, and distribute that content in connection with operating and improving the Platform. You represent that you own or have the necessary rights to the content you submit and that it does not infringe any third-party rights.

7.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Platform may be used by us without obligation to you, including without compensation or attribution.

8. Third-Party Services and Links

The Platform may contain links to third-party websites or integrate with third-party services. These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party sites or services. Your interactions with third parties are governed solely by their respective terms and policies.

9. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your data as described in the Privacy Policy.

10. Disclaimers

The Platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Jikexao disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific outcomes, results, or career advancement from completing any course or program on the Platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Jikexao and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of or inability to use the Platform.

Our total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the greater of (a) the total amount paid by you to Jikexao in the twelve months preceding the claim, or (b) one hundred Polish zloty (PLN 100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Jikexao and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

13.1 Termination by You

You may close your account at any time by contacting us at [email protected]. Termination of your account does not entitle you to a refund except where required by applicable law or our refund policy.

13.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to the Platform, other users, or Jikexao. Upon termination, your license to access course content will cease immediately.

13.3 Survival

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and any other provisions that by their nature should survive termination shall remain in full force and effect after termination.

14. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, including the availability of any feature, course, or content. We will endeavor to provide reasonable advance notice of material changes where practicable, but are not obligated to do so.

15. Governing Principles

These Terms are intended to be interpreted in a manner consistent with fair dealing and good faith. Where any provision is found to be unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Platform, the parties agree to first attempt to resolve the matter informally by contacting us at [email protected]. We will make reasonable efforts to address your concern within 30 days of receipt.

If informal resolution is not achieved, disputes shall be resolved through binding arbitration or by a court of competent jurisdiction, as determined by applicable law. Nothing in this section prevents either party from seeking injunctive or other equitable relief in cases of intellectual property infringement or unauthorized access to the Platform.
